Why Tesla Solar Cancellations Are Different

Tesla's solar business is essentially two businesses stacked together: the SolarCity legacy book (acquired 2016) and Tesla's post-acquisition originations. The two have very different cancellation profiles.

SolarCity legacy contracts were originated under high-pressure door-to-door sales and frequently contain disclosure defects, misrepresented escalators, and questionable production guarantees. Many predate strict state solar disclosure laws.

Tesla post-acquisition contracts are cleaner on disclosure but often have aggressive performance terms and complicated subscription structures. Cancellation grounds are different but still real.

The 6 Tesla Solar Cancellation Paths

1. The 3-Day Cooling-Off Rule

If you signed within the last 3 business days, federal law gives you 72 hours to cancel any door-to-door sale. Tesla must accept written cancellation and refund deposits within 10 days. Send notice by certified mail, email, and overnight courier on the same day.

2. SolarCity-Era Disclosure Defects

If your contract originated with SolarCity (pre-2016) or with a Tesla door-to-door rep before state-specific disclosure laws tightened, you may have grounds based on missing or defective disclosures. California's Solar Energy System Disclosure Document requirements, in particular, were inconsistently followed by SolarCity reps in the early years.

3. Tax Credit Misrepresentation

One of the most common Tesla/SolarCity sales pitches: "You'll get the 30% federal tax credit." On a leased system, that's impossible — Tesla (or SolarCity) takes the credit as the system owner. If your salesperson promised the credit and you have it in writing, that's fraud in the inducement.

4. Performance Guarantee Breach

Tesla Solar PPAs typically include kWh production guarantees. If your system has consistently underproduced and Tesla hasn't compensated you per the contract, they're in breach. Pull 24 months of monitoring data and compare to the contracted schedule.

5. TILA Rescission (Financed Systems)

If you bought your Tesla Solar system with a loan secured by your home, TILA rescission may give you up to 3 years to void the loan. Common defects: missing Notice of Right to Cancel, inaccurate APR disclosure, undisclosed dealer fees.

6. Tesla Solar Subscription Cancellation

Tesla's newer "solar subscription" product has different cancellation terms than the lease/PPA — often allowing cancellation with system removal at no cost. Read your specific subscription agreement carefully; Tesla doesn't always volunteer the cancellation clause.

What About Selling Your House With Tesla Solar?

This is where Tesla customers get squeezed. The Tesla lease or PPA must transfer to the buyer (who must qualify) or be bought out — and Tesla's buyout quotes for residential systems typically run $25,000 to $40,000+ mid-term. UCC-1 fixture filings against your property can also stall the closing.

Three paths if you're selling:

• Transfer: Free if buyer qualifies. Buyer takes over the contract.
• Buyout: Pay Tesla's quoted amount. Often the worst financial outcome.
• Contest the contract: Use any of the six paths above. If the underlying contract is voidable, the UCC-1 comes off too.

The Tesla Customer Service Trap

One specific warning: Tesla's customer service is not equipped to handle cancellation requests, and they often give homeowners incorrect information that closes legal options. We've seen Tesla reps tell customers "you can't cancel" when, in fact, the contract was voidable — and seen customers accept buyout quotes far higher than necessary because they assumed customer service knew the law.
