Atlanta homeowners are protected by the Georgia Fair Business Practices Act (O.C.G.A. § 10-1-390), which prohibits unfair or deceptive acts or practices in consumer transactions. The Act allows consumers to recover actual damages and attorney's fees. Georgia also has a 3-day cancellation right for home solicitation sales under O.C.G.A. § 10-1-6. The Georgia AG has authority to investigate and prosecute solar companies for deceptive practices.
Georgia Power's net metering program is more limited than those in California, Texas, or Florida — a fact that was often not disclosed during the sales process. Atlanta's significant tree canopy also creates shading issues that reduce solar production, and site assessments often underestimated the impact. Sales companies that sold solar using savings projections that overstated Georgia Power's net metering benefits were making materially misleading representations.
