Denver homeowners are protected by the Colorado Consumer Protection Act (C.R.S. § 6-1-105), which prohibits deceptive trade practices in connection with the sale of any goods or services. The Act allows consumers to recover actual damages, up to three times actual damages for bad-faith conduct, and attorney's fees. Colorado also has a 3-day cancellation right for home solicitation sales under C.R.S. § 5-3-403. The Colorado AG has authority to investigate and prosecute solar companies for deceptive practices.
Denver's solar market was built on Xcel Energy's relatively favorable net metering program. When Xcel reduced its net metering rates in 2022, the savings projections that homeowners were sold became less accurate. Colorado's hail risk — one of the highest in the country — also creates warranty and performance issues that were often not addressed in the sales process. Sales companies that sold solar using pre-change projections without disclosing the regulatory risk were making materially misleading representations.
